Hello, I'm Kurt Delsack, California lemon law attorney. Today I'm going to give you a few quick pointers on how to choose a lemon law firm.
The most important decision in winning your case is choosing the right attorney. Start by checking the State Bar of California website, Calbar.CA.gov
Check the number of years the individual attorney has been practicing law in California, and specifically how long she or he has been practicing lemon law.
Watch out for inflated claims. Newly licensed lawyers or those firms just getting into the field may puff up their website resumes.
Beware of out-of-state firms who claim to be California lemon law firms merely by associating with a California attorney.
And watch out too for websites by recent law school graduates and firms that give the impression that they solely practice the California lemon law, when all they're really doing is adding the words "lemon law" to their long list of other so-called legal services.
Beware of firms that boast of their success in litigation because the vast majority of lemon law cases are settled by negotiation without going through the hassle of litigation. Litigation is the result of failing to negotiate a successful settlement. Ask too about the law firm's success rate.
Beware of lemon law mills.These are firms that do extensive advertising and will accept weak cases in hopes of reaching a quick settlement for their clients and quick attorneys fees for themselves.
Check the attorney's website for clients testimonials. And you should never have to pay for a review and analysis of your case.
Many firms advertise free attorneys fees. You should ask exactly what free means. Some firms will ask you to pay for costs up front even though they say free, or may later deduct a significant percentage of your recovery. In California, manufactures pay most if not all reasonable lemon law attorneys fees.
